Terms & Conditions

1.General

1.1 This Surface Protect site at surfaceprotect.co.nz (the “site”) is a shopping website where you can browse, select and order products from DJ & MS Beggs trading as 'Surface Protect '(“Surface Protect”, “us” or “we”).

2. Compliance

2.1 By placing an order with us it is accepted that the user (“you”) have read, understood and agreed to the following terms and conditions.

3. Placing an order

3.1 You may order a product by selecting ‘Add to cart’ for any items that you wish to purchase, filling in required details, selecting buy now, then entering payment details.

3.2 Any order placed through this site for a Product is an offer by you to purchase the particular product for the price notified (including the shipping and other charges and taxes) at the time you place the order.

4. Payment options

4.1  We will bill all transactions in New Zealand Dollars.

4.2 We accept payment using the following major credit cards; Visa and Mastercard.

4.3  If you choose to pay by credit card, you authorise us to debit the amount that is payable for an accepted order from your nominated credit card.

4.4 If you do not wish to pay by Credit Card we accept bank deposits

4.5 You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.

4.6 Your order confirmation will be your receipt specifying the total fees and charges for the Products in the order.

5. Tax charges

5.1 All of our prices are inclusive of 15% GST

6 . Cancelling an order

6.1 We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

(a) the products in that order are not available; or

(b) there is an error in the price or the product description posted on the Site for the Product in that order; or

(c) that we reasonably believe your order has been placed in breach of these terms and conditions.

If we do so, then we will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order.

6.2 You may cancel an order (whether it is accepted by us or not) by contacting us at any time prior to the dispatch of that order. Once the order has been dispatched for delivery to you, then you may return the relevant products only in accordance with the returns policy terms and conditions.

7.Delivery

7.1 We will only deliver products ordered through the Site to a location where we provide delivery services.

7.2 A Shipping Fee will be charged for all orders.

7.2.1 The Regular Shipping Fee is between $5.00-$10.80 depending on size, including GST.

7.2.2 If Rural, The Shipping Fee is between  $12.30-$16.50 depending on size, including GST.

7.3  We will take all reasonable steps to ensure delivery of our goods in a timely and efficient manner. All items sent have their own unique tracking number.

7.4 You must provide a New Zealand physical address for delivery with your order.  Delivery can not be made to a PO BOX

7.5 You acknowledge and agree that any person at the delivery address who receives the products is authorised by you to receive your order.

7.6 Delivery may take up to 7 working days.

7.7 While every effort will be made to ensure delivery within the specified timeframes, there is no way for us to guarantee delivery by a certain date.  Should unforeseen circumstances result in late delivery we will not be liable where such circumstances result in a delay in delivery, or failure to deliver, including that the order may not be cancelled.

8. Out of Stock/Back orders

8.1 If we do not have a particular product in stock then we will use reasonable endeavours to order the relevant products.  In this instance we will notify you of the relevant back ordered products and the anticipated delivery date.  You may select to have a refund instead of waiting for the product.

9  Returns Policy

9.1 Returns are subject to a number of terms.  Any returns received outside of these terms may not be accepted.

9.2 Damaged products

9.2.1 You must check any products delivered to you to determine if it is damaged.  If a product is damaged on delivery you must refuse to accept receipt of that product and notify us immediately.

9.2.2 We will not be liable for any damage once you accept receipt of delivery.

9.3. Products under guarantee

9.3.1 If you believe you are covered by our guarantee you must notify us immediately.  We will determine whether you are covered by the guarantee.

9.3.2 We may require you to send the remainder of the product back to us. If so, we will provide you with details of a return address. You are responsible for shipping any items back to us and are liable for all freight charges.

9.3.3 If we determine that you are covered by the guarantee, we will refund the purchase price of the product not including any shipping charges when we receive the returned product in a condition which we deem acceptable.

9.4. Products covered by warranty

9.4.1 If you believe you are entitled under a warranty, please contact us immediately.  We will determine whether the product is covered by warranty.  We retain the discretion to inspect, repair, replace or refund.

9.5 Statutory Rights

9.5.1 These terms and conditions do not affect your statutory rights under the Consumer Guarantees Act or the Fair Trading Act.  If any single term or part thereof is found to be illegal, all other terms remain applicable.
